Arizona Defensive Driving · Eligible Violations
Which Arizona tickets qualify for defensive driving?
Nearly every civil moving violation. The state’s official list runs 137 entries, and all of them are on this page. When your violation is on it, the court must allow the class once you elect it. One criminal charge can qualify if a judge allows it. A short list never qualifies. Here’s the whole picture.

Six categories, 137 entries
On the list, the court must allow it. The one criminal exception is criminal speeding — with the presiding judge’s permission only.
The fine print, up front
Three rules that apply to every ticket
Schools check the statewide database before you can enroll. The 12-month rule is settled before you pay — not after.
The four boxes that decide eligibility
- The violation date starts your clock The once-every-12-months rule is counted violation date to violation date — not from the day you finished a class.
- The ARS section is what you look up Check it against the Supreme Court's list below. On the list means the court must allow the class when you elect it.
- Civil or criminal decides the path Civil moving violations are the program. The one criminal exception is criminal speeding, and only with the presiding judge's express permission.
- That court is who you elect with The court named on your citation is the one you elect with. For criminal speeding, its presiding judge is the one who can allow the class.
- Finish at least 7 days before this date Courts set and extend their own deadlines, so confirm yours — but 7 days ahead is the rule to plan around.
What qualifies
Which Arizona violations are eligible, by category?
Civil speeding, every flavor
Exceeding the limit. Speed not reasonable and prudent. Failing to control speed to avoid a crash.
Red lights & stop signs
Running a steady red. Disobeying a traffic-control device. Rolling a stop sign, or failing to yield at a yield sign. All on the list.
Yields, turns & move-over
Failing to yield on left turns, at intersections, or from driveways. Plus emergency-vehicle and move-over violations.
Lanes, passing & tailgating
Unsafe lane changes and improper passing. Crossing the gore area. Following too closely. The everyday flow-of-traffic citations.
Handheld, texting & HOV
Arizona’s hands-free violations and HOV-lane tickets qualify. Drivers often assume these two are excluded. They’re not.
City-code versions too
A moving violation written under a city or town ordinance counts like one under state law. So do civil school-bus passing violations.
The one criminal exception: criminal (excessive) speeding — more than 20 over, or more than 35 approaching a school crossing. It can be diverted only at the court’s discretion, with the express permission of the presiding judge. The three “CM” rows in the table below are those charges. How to ask for that permission, step by step.

This table is copied from the Arizona Supreme Court’s List of Eligible Violations, read . The court publishes 137 rows. One section, 28-851B, appears twice, so the table holds 136 distinct sections. Your citation may carry extra codes. A number shows the speed over the limit. “SO” means a sheriff wrote it. “PE” means photo enforcement. These codes are for local tracking only. They do not decide eligibility. If the court’s page and this table ever disagree, the court’s page wins.

The payoff
On the list? Here is what happens next.
Dismissed, no fine. For non-CDL drivers, off your record with no points.
Complete the class by your deadline and the court dismisses the citation. For non-CDL drivers, Arizona MVD never puts it on your driving record. No points are assessed, and the program’s fees replace the fine. $39.95 to us covers the course, audio, certificate, and court filing. The state and your court add their set fees — identical at every school. The cost guide adds up your court’s exact total.
Same-day approval, usually 10–15 minutes. Full course details on the Arizona defensive driving page. Curious what paying the ticket would cost your license instead? The points guide.
Eligibility questions, answered
Eligible-violations FAQ
Which Arizona tickets qualify for defensive driving?
Nearly every civil moving violation. That covers speeding, red lights and stop signs, and right-of-way and move-over violations. It also covers following too closely, unsafe lane changes and improper passing, HOV-lane violations, and handheld-phone and texting tickets. The local-ordinance versions of all of these qualify too. The Arizona Supreme Court publishes the full list — 137 entries, and every one of them is on this page. If your violation is on it, the court must allow the class when you elect it.
Which violations are never eligible?
Any violation that caused a death or serious injury. Criminal charges such as DUI, reckless driving, aggressive driving, and street racing. Tickets you got while driving a commercial vehicle. And non-moving tickets, like parking, registration, insurance, and equipment. A court can still order you to take a class for one of these. But an ordered class does not dismiss the ticket.
My charge is ARS 28-622.01. Can defensive driving dismiss it?
No. ARS 28-622.01 is unlawful flight from a police vehicle — fleeing from the police. It is a class 5 felony, not a civil ticket. It is not on the list above, so the class cannot reach it. The only criminal charge the program covers is criminal speeding, and only with the presiding judge's permission. Don't confuse it with ARS 28-622, failing to obey a police officer. That one is a class 2 misdemeanor. It is not on the list either. For a felony charge, talk to an Arizona defense lawyer, not a driving school. Did the same stop also bring a civil moving violation? That ticket may qualify on its own. Email support@highwaytrafficschool.com and we'll check it against the official list with you, before you pay anything.
Can I dismiss a photo-radar ticket with defensive driving?
Photo-enforcement tickets can qualify, the same as any other. The catch is timing. The first thing in the mail is a notice of violation. A notice is not a ticket yet, so you can't sign up with it. Once it becomes a citation, check that citation against the official list. Email support@highwaytrafficschool.com and we'll look with you — or text or call 1-888-406-1726, Mon–Sat, 7am–7pm PT.
I got two tickets from one stop. Can the class cover both?
No — one eligible violation per attendance, once every 12 months. If you were cited for multiple violations, the class can divert one of them. The rest proceed normally with the court. Pick the one that matters most — usually the highest fine, or the one carrying more points if convicted.
I took defensive driving last year. Can I take it again?
Only if more than 12 months have passed between violation dates. The clock runs from the violation you used the class for last time to your new violation. It does not run from the day you finished the class. Schools check the statewide database before enrolling you, so you'll know before you pay.
Can I fight the ticket first and take the class if I lose?
No. Arizona makes you choose: go to court or take the class — never both. If you elect defensive driving, you complete it at least 7 days before your scheduled court date. The citation is dismissed. If you contest the ticket instead, the class is off the table for that citation.
I have a CDL. Is my ticket eligible?
Only if the ticket came in your personal vehicle. That means one that needs just a regular Class D or motorcycle license. The vehicle also can't have been in commercial use. Tickets in commercial vehicles can't be diverted. One more CDL rule: your completion is handled under a special statute, ARS 28-3394.01. The violation shows on your record as an abstract of judgment — a short court record. But there is no fine. It can't be used against your license. And private-passenger insurers must treat it as dismissed.
I already paid my ticket. Can I still take the class?
No — paying the fine closes the citation as a conviction, and the diversion window closes with it. The class has to be elected instead of payment, not after it. If you haven't paid yet, you're still in the window.
Your ticket's on the list. Get it dismissed.
